These Terms and Conditions govern all equipment rental agreements between Heavy Equipment Bangladesh and its clients. By renting any equipment or vehicle from us, the client agrees to fully comply with all terms listed below. Please read carefully before proceeding with any rental booking.

1. Working Hours & Overtime

One standard working day is defined as 8 (eight) hours, and one standard working month is defined as 240 (two hundred and forty) hours.

  • Any work performed beyond the standard 8-hour working day will be considered overtime and will be charged at the applicable overtime rate.
  • Any work performed beyond the standard 240-hour working month will similarly be charged as overtime.
  • Overtime rates will be communicated to the client prior to commencing work and must be agreed upon in writing.
  • Work during public holidays and government holidays in Bangladesh will be charged at a separate holiday rate, which will be specified in the rental agreement.

2. Food and Accommodation

The client shall be responsible for providing proper food and accommodation arrangements for all equipment operators, drivers, and helpers assigned to the project site.

  • The client shall provide a daily food allowance for each operator, driver, and helper as agreed upon in the rental contract.
  • The client shall arrange safe and adequate accommodation for operators, drivers, and helpers for the duration of the rental period, particularly for projects outside Dhaka or in remote locations.
  • If the client fails to provide food and accommodation, Heavy Equipment Bangladesh reserves the right to arrange these independently and bill the cost to the client.

3. Fuel Supply

The client shall be solely responsible for supplying all fuel (diesel or other required fuel) necessary for the operation of the rented equipment or vehicle throughout the rental period.

  • The client must ensure a continuous and adequate supply of fuel at all times to avoid operational delays.
  • Heavy Equipment Bangladesh will not be held responsible for any project delays caused by fuel shortages on the client’s side.
  • In the event that Heavy Equipment Bangladesh supplies fuel on behalf of the client, the cost will be invoiced to the client at the prevailing market rate plus a service charge.
  • The client must use only the correct grade and type of fuel as specified for each piece of equipment. Any engine damage resulting from use of incorrect fuel will be the client’s full financial responsibility.

4. Mobilization and Demobilization Cost

The client shall bear all costs associated with the mobilization (delivery) and demobilization (return) of the equipment or vehicle to and from the project site.

  • Mobilization costs include transportation, loading, unloading, and any permits required for oversized or heavy haulage across Bangladesh.
  • Demobilization costs include the same categories upon completion or termination of the rental agreement.
  • Mobilization and demobilization costs will be quoted separately from the rental rate and must be agreed upon in writing before delivery.
  • If the project site changes during the rental period, additional mobilization costs for equipment relocation will be borne entirely by the client.

5. Advance Payment

To confirm any equipment rental booking, the client is required to make an advance payment as follows:

  • 100% of the mobilization cost must be paid in full before the equipment or vehicle is dispatched for delivery.
  • 50% of the total rental amount must be paid in advance before the equipment or vehicle is delivered to the project site.
  • The remaining 50% of the rental amount must be paid as per the payment schedule agreed upon in the rental contract.
  • Heavy Equipment Bangladesh reserves the right to withhold equipment delivery until all required advance payments have been received and confirmed.
  • All payments must be made via bank transfer or other approved payment methods. Cash payments must be confirmed with an official receipt.
  • Advance payments are non-refundable in the event of cancellation by the client after equipment dispatch.

6. Safety and Security

The client shall be fully responsible for ensuring the safety and security of all rented equipment and vehicles throughout the entire rental period.

  • The client must ensure that rented equipment is operated only by qualified and authorized personnel in accordance with the manufacturer’s guidelines.
  • The client must provide a safe working environment for all equipment operators, drivers, and helpers on site.
  • The client is responsible for protecting the equipment from theft, vandalism, unauthorized use, and damage during the rental period.
  • Any theft or loss of rented equipment during the rental period will be the full financial responsibility of the client.
  • The client must comply with all applicable Bangladesh labor laws, safety regulations, and construction site safety standards during the rental period.
  • Heavy Equipment Bangladesh reserves the right to withdraw any equipment from a project site that it deems to be unsafe or in violation of standard safety practices.

7. Equipment Damage and Repairs

  • The client is responsible for any damage to the rented equipment caused by misuse, negligence, accidents, or improper operation during the rental period.
  • Normal wear and tear is accepted and covered by Heavy Equipment Bangladesh.
  • Any damage beyond normal wear and tear must be reported immediately to Heavy Equipment Bangladesh.
  • The cost of repairs for client-caused damage will be assessed by Heavy Equipment Bangladesh and invoiced to the client.
  • The client must not attempt any repairs on the rented equipment without prior written authorization from Heavy Equipment Bangladesh.
  • Heavy Equipment Bangladesh will carry out all authorized repairs using its own technicians or approved service partners.

8. Equipment Breakdown and Downtime

  • Heavy Equipment Bangladesh will make every effort to ensure all rented equipment is in good working condition at the time of delivery.
  • In the event of a mechanical breakdown that is not caused by the client’s misuse or negligence, Heavy Equipment Bangladesh will arrange repairs or a replacement unit as quickly as possible.
  • No rental charges will apply for downtime periods caused by mechanical failure that is the responsibility of Heavy Equipment Bangladesh.
  • Downtime caused by the client’s actions — including misuse, incorrect fuel, unauthorized modifications, or site conditions — will still be charged at the standard rental rate.
  • The client must notify Heavy Equipment Bangladesh immediately of any breakdown or equipment malfunction.

9. Rental Period and Extension

  • The rental period begins on the date the equipment is delivered to the project site and ends on the date it is collected by Heavy Equipment Bangladesh.
  • The client must notify Heavy Equipment Bangladesh at least 48 hours in advance if they wish to extend the rental period.
  • Rental extensions are subject to equipment availability and must be confirmed in writing.
  • Failure to notify of an extension will result in the client being charged at the standard daily rental rate for each additional day the equipment remains on site.

10. Cancellation Policy

  • Cancellations made before equipment dispatch — the advance rental payment (50%) may be refunded minus any administrative or processing fees. The mobilization cost advance (100%) is non-refundable if logistics have already been arranged.
  • Cancellations made after equipment dispatch — no refund will be provided for mobilization costs or the advance rental payment.
  • Heavy Equipment Bangladesh reserves the right to cancel any rental agreement in cases of force majeure, including natural disasters, political unrest, or other circumstances beyond its control. In such cases, a fair refund will be discussed with the client.
